Memorandum and order of Judge John T. Elfvin filed in the United States District Court for the Western District of New York in which the Plaintiffs’ motion to substitute the Estate of Nelson A. Rockefeller in place of Defendant Nelson A. Rockefeller is granted. Judge Elfvin ordered the plaintiffs’ class certification status revoked, without prejudice, concluding that the named plaintiffs do not adequately represent the class following their failure to comply with a previously order by the Court to commence discovery. The Court further ordered the action dismissed for failure to prosecute, unless the plaintiffs appoint new counsel and such counsel obtain Judge Elfvin’s consent to substitution.
