Proceedings of the court of the Nine men. Actions of debt. Abraham Verplanck vs. Dirrick Teunissen Noorman; plaintiff demands why defendant burns lime on his land, and does not till it as he agreed to, the lime burning impoverishing the soil and not improving it, whereby plaintiff is deprived of the benefit that was to accrue to him from the cultivation of the ground, viz., the fourth part; judgment for plaintiff, who is authorized to take away the fourth part of the lime as his share.
